The contract on the customers end was for a commitment to pay for an entire year of WoW game time. Not the game time itself. Contracts go both ways. Both parties have obligations. Blizzard's obligation was to ensure Beta access is granted as stated and advertised as well as Diablo and a free mount. No one needed to sign the contract to simply pay for game time only.

You falsified your expectations by assuming you would get in right away. Just because they're handling this beta a little differently then previous betas does not mean that you are entitled to get in on the very first day that it's live.

EDITED TO ADD: Honestly speaking, Beta isn't even "live" at the moment. You cannot level a Panda past level 10. Most of the stuff isn't even working. It's starting, but I personally don't call it "live" yet.

As long as I get in Beta I don't care. It sucks I couldn't get it yesterday or today, but I am not going to QQ over it. I rather wait anyway till the fuss dies down a bit so I am not in Lagville, Azeroth while trying to test and explore it. Just my 2 cents....

I was fine with what I read in the contract. As well as what Mike Morhaime said and the advertisement for the Annual Pass stated. All that fine and great. It's the events of the last few days that upset me. It's not my job to hold Blizzard's hands and walk them through the steps to ensure they have enough servers to accommodate the customers they gained or kept through very large very deliberate advertising campaign. An FAQ posted March 20th, months after people signed the contract, can hardly be used as a credible example of "see you knew what you signed up for".

To be honest, nope. Blizzard's job is to make Blizzard money and please most of its people. It sounds mean, but...we're not special. I'm not. You're not. We're one of 10 million people. For all the complaining and fussing over this, that's still only a tiny, tiny percentage of people.
They would rather do the job right than please any one particular person. They do what is best for the company. Not what is best for you, or for me, or for Joe Everyman over there who is mad about it as well.
Blizzard is a business. They are running it as a business does. That's how they have always done it.
It says over and over and over in the TOS "Subject to change". You agreed when you signed that you would deal with it if/when it happened. So it has happened and so we must deal.
Would it be nice to have gotten in this early? Sure. However it is unreasonable to assume and so I did not.

They posted the FaQ before the beta went live, meaning if you read it you knew what you were getting into as it explicitly states *exactly* how they were planning on handling the invites for Annual Pass holders. If you want to argue the semantics of that further, then you need to take your issues up with Blizzard, not us.
By signing up to use one of Blizzard's products you also sign a ToS that allows them to change things on a whim depending on how they think it will best suit the game and their company.

There are four Beta servers, correct? Divide the 1,000,000 people by four and that is approx. 250,000 per server.
Most live servers, running current content, have...what? 25,000? If that?
The servers cannot handle 250,000 people when they are running current content. There is no way the Beta servers can handle it when they are highly unstable.
That is just a fact. And there is no logical reason for Blizzard to waste the money, effort, and man-power to put up more servers. It would be a poor business plan and they are a business.

I think trying to sue them is stupid, but I don't fault people for being upset. You cannot deny they made certain wordings to make people think that they would be right off the bat in the beta.
I even thought so, but I also fully expected to not get my invite forever now that i fully realize that isnt how its working.
